We have extensive experience in these two highly effective techniques for finding mutually agreeable solutions to business disputes without litigation.
Mediation and arbitration, designed to keep legal battles out of the courtroom and avoid litigation, are cost-effective and expedient solutions for the firm’s health law clients as well as business and corporate clients. Mediation and/or arbitration may be required by the parties’ contract or may be used by an agreement of the parties as an alternative to litigation. These alternative dispute resolution (ADR) methods may be used to resolve a dispute faster than litigation and with less cost.
Here’s what happens in each:
- In mediation, the parties control the outcome and directly participate in the negotiation of the settlement. A third party neutral (the mediator) is selected by the parties to consider the dispute objectively and to assist the parties in their consideration of resolution alternatives. Mediation has the benefit of an increased likelihood of preserving the parties’ business relationship.
- A time-tested, cost-effective alternative to litigation, arbitration is the submission of a dispute to one or more neutral/impartial persons (arbitrators) for a final and binding decision, known as an award. The neutral third party hears the dispute in a less formal setting than a courtroom. The parties, each represented by their own lawyer, present their evidence and their case. After hearing the evidence, the neutral third party makes a decision and renders an award that is enforceable in court.
